01 Agreement to terms
These Terms of Service ("Terms") constitute a binding legal agreement between you and LuckyStep ("LuckyStep", "we", "our", or "us") governing your use of the LuckyStep mobile application, the website at luckystep.org, and any related services (collectively, the "Service").
By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Heads-up: Section 15 contains an arbitration clause and a class-action waiver that affect how disputes between you and LuckyStep are resolved. Please read it carefully.
02 Eligibility
You may use LuckyStep only if you:
- Are at least 13 years old (or 16 in the European Economic Area). If you are under 18, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
- Have the legal capacity to enter into a binding contract.
- Are not barred from using the Service under the laws of your jurisdiction or any sanctions list (including the U.S. Treasury OFAC list).
- Will use the Service in compliance with all applicable laws.
LuckyStep is offered globally, but some features (including specific gift cards) may not be available in your country.
03 Your account
To use most features, you must create an account. You agree to:
- Provide accurate, current, and complete information.
- Maintain only one account. Duplicate accounts will be merged or terminated, and any coins on duplicate accounts may be forfeited.
- Keep your password secure and confidential. You are responsible for all activity that occurs under your account.
- Notify us immediately at security@luckystep.org of any unauthorized use.
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion, particularly where we suspect fraud or violation of these Terms.
04 The Service
LuckyStep is a pedometer and rewards platform. The Service allows you to:
- Track your daily steps using your device's built-in motion sensor.
- Complete daily quests, challenges, and check-ins to earn virtual coins ("Coins").
- Redeem Coins for digital gift cards from a curated set of brand partners.
- View health and activity insights, streaks, and achievements.
We may add, change, or remove features at any time. We may also stop offering the Service in your country. Where these changes affect your existing Coin balance or pending rewards, we will provide at least 30 days' notice.
05 Coins & rewards
5.1 Nature of Coins
Coins are a limited, revocable, non-transferable, non-sublicensable license to redeem against the rewards we make available in the App. Coins:
- have no monetary value outside the LuckyStep ecosystem;
- are not legal tender, securities, virtual currency, or cryptocurrency;
- cannot be sold, traded, gifted, or transferred to another user or account;
- cannot be converted into cash or any other form of value except as offered through the App's rewards catalog.
5.2 Earning Coins
You can earn Coins only through the methods described in the App: hitting step goals, completing quests, daily check-ins, streak bonuses, watching sponsored content (where available), and similar in-app activities. We may change earning rates, quest rules, or available activities at any time.
5.3 Redeeming Coins
You may redeem Coins for digital gift cards listed in the App's rewards catalog. The Coin cost, monetary value, region availability, and any limits are shown before you confirm a redemption. Once a redemption is confirmed:
- The corresponding Coins are deducted from your balance immediately.
- The gift card is typically delivered to your registered email within minutes; in rare cases delivery may take up to 24 hours.
- Redemptions are final. We cannot reverse a redemption once Coins have been deducted, except where required by law or where we determine the redemption was the result of a system error on our part.
5.4 Coin expiration & account inactivity
Coins do not expire while your account remains active. If you do not log into the Service for 12 consecutive months, we may, upon 30 days' email notice, expire any unredeemed Coins and close inactive accounts.
5.5 Gift card terms
Gift cards are issued by the respective brand partners, not by LuckyStep. Once delivered, gift cards are subject solely to the terms and conditions of the issuing brand (including expiration dates, geographic restrictions, and redemption rules). LuckyStep is not responsible for lost, stolen, expired, or unusable gift cards once they have been delivered to the email address you provided.
06 Fraud prevention
To keep the rewards system fair and economically sustainable, we monitor for fraudulent activity. We may, at our sole discretion:
- Adjust or revoke Coins earned through means we determine to be fraudulent, abusive, automated, or otherwise inconsistent with the spirit of the Service.
- Refuse to fulfill redemptions pending verification.
- Require additional identity verification (e.g., phone verification, photo of a government-issued ID) for high-value redemptions or where fraud is suspected.
- Suspend or permanently terminate accounts found to be using bots, emulators, shaking devices mechanically, modifying step counts via third-party apps, creating multiple accounts, or engaging in any other form of manipulation.
Any Coins or rewards obtained through fraudulent means may be forfeited without compensation.
07 Prohibited conduct
You agree not to:
- Use any automated means (bots, scripts, scrapers, emulators, mechanical step generators) to interact with the Service.
- Reverse engineer, decompile, or disassemble any part of the Service except to the extent permitted by applicable law.
- Attempt to gain unauthorized access to other users' accounts, our systems, or our partners' systems.
- Use the Service to send spam, phishing, or other unsolicited communications.
- Resell, rent, lease, or commercially exploit the Service or any Coins or rewards earned from it.
- Interfere with the operation of the Service, including by introducing viruses, malware, or excessive load.
- Misrepresent your identity, age, or eligibility.
- Use the Service for any unlawful purpose or in violation of any applicable law.
08 User content
If you submit content to the Service (e.g., a profile photo, support message, or referral message), you grant LuckyStep a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and display that content solely for the purpose of operating and improving the Service. You retain all ownership rights to your content.
You represent that you have all rights necessary to grant this license and that your content does not violate any third-party rights or applicable laws.
09 Intellectual property
The Service, including all software, text, graphics, logos, designs, audio, video, and other content (excluding User Content), is owned by LuckyStep or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved.
"LuckyStep" and the LuckyStep logo are trademarks of LuckyStep. You may not use them without our prior written permission.
10 Third-party services
The Service may contain links to or integrations with third-party services (e.g., Google Play, Google Sign-In, gift card issuers). LuckyStep does not control these services and is not responsible for their content, terms, or privacy practices. Your use of third-party services is governed by their own terms.
11 Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, LuckyStep disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising out of course of dealing or usage of trade.
LuckyStep does not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Step counts, calorie estimates, or other health metrics will be accurate.
- The Service is suitable for any medical, fitness, or health purpose.
- Any specific Coins or rewards will remain available.
LuckyStep is not a medical app. Consult a qualified healthcare professional before beginning any new exercise program.
12 Limitation of liability
To the maximum extent permitted by law:
- LuckyStep will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, data, goodwill, or other intangible losses) arising out of or related to your use of the Service.
- LuckyStep's total cumulative liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) USD $50 or (b) the total monetary value of gift cards you have redeemed through the Service in the 12 months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply only to the extent permitted by law.
13 Indemnification
You agree to indemnify, defend, and hold harmless LuckyStep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit through the Service.
14 Termination
You may stop using the Service and delete your account at any time from within the App or by emailing hello@luckystep.org.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including:
- Violation of these Terms, our Privacy Policy, or applicable law.
- Suspected fraud, abuse, or harm to other users.
- Extended inactivity (see Section 5.4).
- Discontinuation of the Service in your region.
Upon termination: (a) your right to use the Service ends; (b) any unredeemed Coins are forfeited (except where termination is due to our discontinuation of the Service, in which case we will give you a reasonable opportunity to redeem them); (c) the provisions of these Terms that by their nature should survive termination (including Sections 9, 11–13, 15, 16) will survive.
15 Disputes & arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
15.1 Informal resolution
Before filing a formal dispute, you agree to first contact us at legal@luckystep.org and try to resolve the dispute informally for at least 30 days.
15.2 Binding arbitration
If we cannot resolve a dispute informally, you and LuckyStep agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively through final and binding arbitration, conducted by JAMS under its Streamlined Arbitration Rules. The arbitration will be held in Wilmington, Delaware, or, if you live outside the United States, by telephone or video conference. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
15.3 Class-action waiver
You and LuckyStep agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
15.4 Opt-out
You may opt out of Sections 15.2 and 15.3 by sending written notice to legal@luckystep.org within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.
15.5 Exceptions
Either party may bring an individual action in small claims court, or seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
16 Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Where Section 15 does not apply, the state and federal courts located in Wilmington, Delaware will have exclusive jurisdiction.
If you live in the European Economic Area, United Kingdom, or Switzerland, nothing in these Terms deprives you of the mandatory protections of the law of the country in which you reside.
17 Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and by posting a notice in the App at least 14 days before the changes take effect. By continuing to use the Service after the effective date of revised Terms, you agree to the revised Terms. If you do not agree, you must stop using the Service.
18 Miscellaneous
- Entire agreement. These Terms (together with the Privacy Policy and any additional terms posted in the App) constitute the entire agreement between you and LuckyStep regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions will continue in full force.
- No waiver. Our failure to enforce any right or provision is not a waiver of that right.
- Assignment. You may not assign these Terms. We may assign them, in whole or in part, to any successor or affiliate.
- Force majeure. Neither party will be liable for delays or failures caused by events beyond reasonable control.
- Notices. We may give notices by email to the address on your account, by posting in the App, or by posting on the Site. You must send notices to us at legal@luckystep.org.
- Language. These Terms are provided in English. Translations are for convenience only; the English version controls.
